These Terms of Service (“Terms”) govern your use of AccountabilityEDGE, an executive coaching and accountability app provided by AccountabilityEDGE (“we,” “us,” or “our”). By using our app, you agree to these Terms.
What We Provide
AccountabilityEDGE connects you with professional coaches who help you set goals, track progress, and stay accountable. Our app facilitates communication between coaches and clients, goal tracking, progress check-ins, and motivational support.
Your Account
To use AccountabilityEDGE, you need to create an account. You’re responsible for:
- Providing accurate information when signing up
- Keeping your login credentials secure
- All activity that occurs under your account
If you notice any unauthorized use of your account, please contact us immediately.
Acceptable Use
We want AccountabilityEDGE to be a positive, productive space. When using our app, please:
- Be respectful in all communications
- Use the app only for its intended purpose
- Not share content that is harmful, illegal, or inappropriate
- Respect the privacy and confidentiality of coaching relationships
Coaching Relationship
Coaches on our platform are independent professionals. While we verify their credentials, the coaching relationship is between you and your coach.
Important: Coaching is NOT therapy, counseling, psychiatric treatment, or medical advice. Coaching is also NOT legal or financial advice. Coaches help you set and achieve goals, but they are not acting as licensed therapists, doctors, lawyers, or financial advisors. If you need professional help in these areas, please consult appropriately licensed professionals.
Content You Share
You retain ownership of the goals, notes, and messages you share through the app. By using our service, you give us permission to store and process this content to provide our services. We will never sell your personal content to third parties.
Payments and Subscriptions
Some features of AccountabilityEDGE may require payment. All fees are clearly displayed before purchase. Subscriptions automatically renew unless cancelled. You can manage your subscription in your account settings or through your app store.
Cancellation and Refunds
You can cancel your subscription at any time. After cancellation, you’ll continue to have access until the end of your billing period. Refund requests are handled on a case-by-case basis—contact us at support@thirdpeakstudio.com.
Changes to the Service
We’re always working to improve AccountabilityEDGE. We may add, modify, or remove features over time. We’ll notify you of significant changes through the app or email.
Limitation of Liability
While we work hard to provide a reliable service, we can’t guarantee uninterrupted access or that the app will meet all your needs. We’re not liable for:
- Results you achieve (or don’t achieve) through coaching
- Technical issues beyond our reasonable control
- Actions of coaches or other users
Our total liability is limited to the amount you’ve paid us in the past 12 months.
Ending Our Relationship
You can delete your account at any time through the app settings. We may also suspend or terminate accounts that violate these Terms. Upon termination, your right to use the app ends, though certain provisions of these Terms will survive.
Intellectual Property
The AccountabilityEDGE app, including its design, features, and content we provide, belongs to AccountabilityEDGE. You may use the app for its intended purpose, but you can’t copy, modify, or distribute it. “AccountabilityEDGE” is our trademark.
You keep ownership of your content (goals, notes, messages). We don’t claim rights to your personal information beyond what’s needed to provide our services.
Your Responsibility for Misuse
If you misuse our service in a way that causes us legal problems or financial loss (for example, by uploading illegal content or violating someone’s rights), you agree to cover any resulting costs, including legal fees. This is what lawyers call “indemnification.”
Disputes and Legal Terms
If you have a concern about our service, please contact us first at support@thirdpeakstudio.com. We prefer to resolve issues directly and informally.
If we can’t resolve a dispute informally, we both agree to resolve it through binding arbitration rather than in court, except for small claims court cases. This means a neutral arbitrator will decide the dispute, not a judge or jury. You also agree to resolve disputes individually, not as part of a class action.
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict of law principles.
Additional Legal Terms
A few more legal details that protect both of us:
- Entire Agreement: These Terms, along with our Privacy Policy, are the complete agreement between us.
- Severability: If any part of these Terms is found invalid, the rest still applies.
- No Waiver: If we don’t enforce a part of these Terms, that doesn’t mean we give up the right to enforce it later.
- Assignment: We may transfer these Terms to another company (for example, if we’re acquired), but you can’t transfer your account without our consent.
- Force Majeure: We’re not liable for failures caused by things beyond our control (natural disasters, internet outages, etc.).
Privacy
Your privacy matters to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using our app, you also agree to our Privacy Policy.
